Area Code Elite AAU Liability Waiver, Release Form & Agreement

PLEASE READ CAREFULLY BEFORE PARTICIPATING

This Liability Waiver, Release Form, and Agreement (“Agreement”) is entered into by the undersigned participant (“Athlete”) and, if the Athlete is under 18 years of age, their parent or legal guardian (“Guardian”), in favor of Area Code Training LLC, doing business as Area Code Elite, including its owners, coaches, staff, employees, contractors, volunteers, agents, representatives, sponsors, and affiliates (collectively referred to as “Area Code Elite”). This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, and any disputes shall be brought exclusively in the courts of Maricopa County, Arizona. By participating in any Area Code Elite activities, the Athlete and/or Guardian acknowledges and agrees to all terms outlined below.

ASSUMPTION OF RISK

The Athlete and/or Guardian understands and acknowledges that participation in basketball tryouts, practices, games, training sessions, tournaments, travel, and all related activities (“Activities”) involves inherent risks, including but not limited to physical injury, illness, permanent disability, or death.

The Athlete voluntarily chooses to participate and assumes full responsibility for any risks, injuries, or damages that may occur as a result of participation in the Activities.

WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in the Activities, the Athlete and/or Guardian, on behalf of themselves and their heirs, assigns, and representatives, hereby releases, waives, and holds harmless Area Code Elite from any claims, liabilities, damages, or losses arising from participation in the Activities, including those resulting from negligence.

MEDICAL CONSENT & INSURANCE

The Athlete and/or Guardian is solely responsible for maintaining adequate health insurance coverage. The Athlete and/or Guardian authorizes Area Code Elite to secure emergency medical treatment if necessary and agrees to assume full responsibility for all related medical costs.

JERSEY RENTAL AGREEMENT

All jerseys issued by Area Code Elite are rented through Area Code Training LLC and remain the property of the organization at all times.

Any damaged, lost, or unreturned jerseys will result in an additional fee of $100 per jersey piece, as follows: $100 per top (2 tops = $200 total) & 100 per short (2 shorts = $200 total)
Total possible replacement cost per player: $400. Failure to return jerseys at the end of participation will result in full replacement charges.

INDEMNIFICATION

The Athlete and/or Guardian agrees to indemnify and hold harmless Area Code Elite from any claims, costs, damages, or legal fees arising from participation in the Activities.

IMAGE RELEASE

The Athlete and/or Guardian grants Area Code Elite permission to use photographs, video, and other media of the Athlete for promotional, marketing, and social media purposes without compensation.

AUTOMATIC ACCEPTANCE OF TERMS

Any athlete who participates in tryouts, practices, games, tournaments, training sessions, or any Area Code Elite activity automatically acknowledges and agrees to be bound by this Agreement in full. Participation in any capacity constitutes acceptance of all terms, including waiver of liability, regardless of whether a physical signature is obtained.

SEVERABILITY

If any portion of this Agreement is found unenforceable, the remaining sections shall remain in full force and effect.

ACKNOWLEDGEMENT OF UNDERSTANDING

The Athlete and/or Guardian acknowledges that they have read, understood, and voluntarily agree to all terms of this Agreement. They understand they are giving up certain legal rights, including the right to sue Area Code Elite for injuries or damages related to participation in the Activities.
